Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you and Dependable Title Services, Inc. ("Company," "we," "us," or "our") governing your use of our website at dependable4u.com (the "Site"), our client portal at app.dependable4u.com (the "Portal"), and any services we provide (collectively, the "Services").

By accessing or using our Services, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use our Services.

We do not provide legal or tax advice regarding property ownership, property taxes, or any legal matters. All information provided on our Site, Portal, and in our resources section is for informational purposes only and should not be construed as legal or tax advice.

Document Preparation Services

As a Licensed Document Assistant (LDA), we are authorized to prepare legal documents at your specific direction. We prepare documents based solely on the information you provide to us. We do not advise you on which documents to use, how to fill them out, or the legal implications of your choices.

Services We Provide

We offer the following services throughout all U.S. counties and equivalents (parishes, boroughs, and towns):

  • Document Preparation & Recording: Preparation and recording of deeds, grants, quitclaims, and other real estate documents
  • Title Search: Comprehensive searches to identify liens, encumbrances, and ownership issues
  • Mail Back Services: Returning recorded documents to property owners
  • County Recording Services: Submission and recording of documents at county recorder offices

Service Fees and Payment

Pricing

Service fees vary depending on the specific service requested. When you create an order through our Portal, you will be presented with the total cost before proceeding to payment. The total may include:

  • Our service fees for document preparation and processing
  • County recording fees (if applicable)
  • Additional fees for rush or expedited services (if selected)

You are under no obligation to proceed with payment. If you choose not to proceed, we will not collect any information related to your order.

Payment Processing

All payments are processed securely through Stripe, a third-party payment processor. We do not store your payment information. Your use of Stripe is subject to Stripe's terms of service and privacy policy.

Rush and Expedited Services

We offer rush and expedited service options for faster processing. You can select these options when creating your order through the Portal. Additional fees apply for rush and expedited services.

Cancellations and Refunds

You may request to cancel your order at any time during the process, subject to the following conditions:

  • Before Work Begins: If you request cancellation before we have started working on your order, you will receive a full refund of our service fees. County recording fees that have already been paid are non-refundable.
  • After Work Begins: If you request cancellation after we have already started processing your order, we will review your request on a case-by-case basis. Refunds for partially completed work are at our sole discretion and will be based on the work already performed.

Client Responsibilities

Accurate Information

You are responsible for providing accurate and complete information about your property and any related documents that may be needed to prepare or record your documents. We prepare documents based solely on the information you provide. Errors in the information you provide may result in errors in your documents or recording delays.

Account Requirements

To use our Portal, you must create an account. You are responsible for:

  • Maintaining the confidentiality of your account credentials
  • All activities that occur under your account
  • Notifying us immediately of any unauthorized use of your account
  • Ensuring your contact information is current and accurate

Prohibited Uses

You agree not to:

  • Use our Services for any illegal purpose or in violation of any laws
  • Provide false, inaccurate, or misleading information
  • Attempt to gain unauthorized access to our systems or other users' accounts
  • Interfere with or disrupt the operation of our Services
  • Use automated systems or software to extract data from our Site or Portal
  • Impersonate any person or entity or misrepresent your affiliation with any person or entity

Intellectual Property Rights

The content on our Site and Portal, including but not limited to text, graphics, logos, images, and software, is the property of Dependable Title Services, Inc. or our licensors and is protected by U.S. and international copyright, trademark, and other intellectual property laws.

You may not reproduce, distribute, modify, create derivative works of, publicly display, or exploit any content from our Services without our prior written permission.

Limitation of Liability

To the maximum extent permitted by law:

  • We provide our Services "as is" and "as available" without warranties of any kind, either express or implied
  • We do not guarantee that our Services will be uninterrupted, timely, secure, or error-free
  • We are not liable for any delays or errors caused by third parties, including county recorder offices, or service providers
  • Our total liability to you for any claims arising from your use of our Services shall not exceed the amount you paid us for the specific service giving rise to the claim

Some jurisdictions do not allow the exclusion of certain warranties or the limitation of liability for incidental or consequential damages. In such jurisdictions, our liability will be limited to the greatest extent permitted by law.

Indemnification

You agree to indemnify, defend, and hold harmless Dependable Title Services, Inc., its officers, directors, shareholders, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in any way connected with:

  • Your use of our Services
  • Your violation of these Terms
  • Your violation of any rights of another person or entity
  • Any information or documents you provide to us

Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law principles.

Any disputes arising out of or relating to these Terms or your use of our Services shall be resolved through binding arbitration in Orange County, California, in accordance with the rules of the American Arbitration Association. You agree to waive any right to a jury trial or to participate in a class action lawsuit.

The invalid or unenforceable provision shall be replaced with a valid and enforceable provision that most closely matches the intent of the original provision.

Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Dependable Title Services, Inc. regarding your use of our Services and supersede all prior agreements and understandings, whether written or oral.
